1. Eligibility and User Accounts

You must be at least 16 years of age (or 18 in certain jurisdictions) to use our Services. You are responsible for safeguarding your account and for all activities that occur under it. You agree to provide accurate and complete information when creating an account. Account authentication is managed securely via our third-party provider, Clerk.

2. Fees, Billing, and Payment

Our Services are offered on a subscription basis. You agree to pay all applicable fees as described on our pricing page. Payments are billed in advance on a recurring basis and are processed by our third-party payment processor, Stripe. You are responsible for providing accurate billing information. All fees are non-refundable except as required by law.

3. Acceptable Use

You agree not to use the Services for any unlawful or prohibited activity. You will not:

• Upload or transmit any data that is illegal, harmful, or violates the rights of others.
• Attempt to reverse engineer, decompile, or otherwise access the source code of the Services.
• Use the Services to send spam or unsolicited messages.
• Interfere with or disrupt the integrity or performance of the Services.

4. Intellectual Property

Our Property

All rights, title, and interest in the Services, including all underlying software, technology, and content (excluding your data), are the exclusive property of Custocom and its licensors.

Your Content

You retain ownership of all data and content you upload to the Services (e.g., knowledge base files). You grant us a worldwide, royalty-free license to use, reproduce, and modify your content solely for the purpose of providing and improving the Services for you.

5. Termination

You may terminate these Terms at any time by deleting your account through your Clerk-managed dashboard. We may suspend or terminate your access to the Services if you breach these Terms or if your use of the Services poses a security risk to us or other users. Upon termination, your right to use the Services will cease immediately.

6. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL CUSTOCOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes by posting the new Terms on this page and, where appropriate, by notifying you via email. Your continued use of the Services after the changes take effect constitutes your acceptance of the new Terms.
